This is an historic tenancy pre 1989 where the tenant cannot be evicted by the landlord and whose rent is controlled by the Fair Rent Officer. The property can only be sold subject to the tenant’s occupation. Any occupant residing with the tenant is entitled to succeed to this tenancy upon the original tenant’s death. Only one succession is permitted.
Assured Tenancy
This is an historic tenancy pre 1989 which, following the original tenant’s death, has been handed down for a second time to a person who lived with the original tenant. The rent is an open market rent and the landlord cannot evict the tenant. The property can only be sold subject to the tenant’s occupation.
Assured Shorthold Tenancy
This is a modern tenancy for an agreed term at a current open market rent and, provided the requisite procedures have been followed at the time the tenancy was granted, the landlord can evict the tenant by serving on the tenant 2 months’ notice. In this way the landlord can sell the property with full vacant possession once the tenant leaves.
